By accessing or using Hadaya ("Service"), available at gethadaya.com and operated by fractal code, you agree to be bound by these Terms of Service ("Terms"). In these Terms, "we," "our," or "us" refers to fractal code as the operator of Hadaya. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Hadaya provides a gift wrapping solution for Salla e-commerce store owners, including:

• A merchant dashboard for managing wrapping paper designs
• An embeddable widget for product pages
• Order tracking for gift-wrapped purchases
• Integration with the Salla e-commerce platform

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have a valid Salla store to use our Service.

3.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and keep your account information updated.

4. Subscription and Payment

4.1 Subscription Plans

Our Service is offered through various subscription plans as displayed on the Salla app marketplace. Subscription details, including pricing and features, are managed through Salla.

4.2 Billing

All billing is processed through the Salla platform. You agree to pay all fees associated with your subscription plan.

4.3 Cancellation

You may cancel your subscription at any time through the Salla app marketplace. Cancellation will take effect at the end of your current billing period.

4.4 Refunds

Refund requests are subject to Salla's refund policies. Contact Salla support for refund inquiries.

5. User Obligations

5.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload malicious content or attempt to compromise our systems
• Interfere with or disrupt the Service
• Use the Service to send spam or unsolicited communications
• Attempt to gain unauthorized access to other accounts or systems

5.2 Content Responsibility

You are solely responsible for:

• All wrapping paper designs you upload
• Gift messages configured through your store
• Ensuring your content does not violate any laws or third-party rights

6. Intellectual Property

The Service, including its design, features, and content, is owned by fractal code and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

6.2 Your Content

You retain ownership of content you upload to the Service. By uploading content, you grant us a non-exclusive license to use, display, and process that content to provide the Service.

Our Service integrates with the Salla platform. Your use of Salla is subject to Salla's terms of service and privacy policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that the Service will meet your specific requirements or expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRACTAL CODE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Service interruptions or data loss
• Third-party actions or content

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless fractal code, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service

• Your violation of any third-party rights
• Content you upload to the Service

12. Termination

12.1 By You

You may terminate your account at any time by uninstalling the app from your Salla store.

12.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause, including for:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• Extended periods of inactivity

12.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data in accordance with our Privacy Policy
• Provisions that by their nature should survive will remain in effect

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms on our website or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to conflict of law principles.
